Smart REAI ("we," "us," or "our") operates the platform at smartrealestateai.com. This Privacy Policy describes how we collect, use, and protect your personal information when you use our AI-powered real estate wholesaling platform.
2. Information We Collect
We collect the following types of information:
- Account Information: Name, email address, phone number, and company name when you create an account.
- Usage Data: How you interact with the platform, including pages visited and features used.
- Device Information: Browser type, IP address, and device identifiers.
3. Your Deal & Contact Data — Complete Privacy
We do NOT access, view, sell, share, or use your proprietary business data. This includes but is not limited to:
- Deals you enter into the platform (addresses, offer prices, ARVs, repair costs, seller info)
- Your buyer lists, contacts, JV partners, lenders, and agents
- Your contract documents and e-signatures
- Your notes, deal activities, and financial calculations
- Your team members' data and communications
Your deal pipeline, contact database, and all business-related information are strictly yours. Our platform enforces row-level security so that only you (and team members you explicitly invite) can see your data. Even Smart REAI staff cannot view your deals or contacts.
4. SMS & Email Communications — TCPA Compliance
By creating an account and using Smart REAI, you acknowledge, agree, and expressly consent to the following:
- Email Communications: You consent to receive transactional and service-related emails, including account verification, password resets, deal notifications, team invitations, and platform updates at the email address you provide.
- SMS/Text Messages: If you provide your phone number, you expressly consent to receive SMS/text messages from Smart REAI related to deal alerts, notifications, reminders, and service updates. Message and data rates may apply. Message frequency varies based on your platform activity.
- Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. You may opt out of non-essential emails via your account settings. Opting out of transactional messages (e.g., password resets) is not available as they are necessary for account functionality.
- No Third-Party Sharing: Your phone number and email address will never be sold, rented, or shared with third-party marketers. We only use your contact information to communicate directly with you about your Smart REAI account and services.
This consent is provided in accordance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all applicable FCC regulations. Consent is not a condition of purchase.
5. How We Use Your Information
- To provide, maintain, and improve the Smart REAI platform
- To authenticate your identity and secure your account

6. Data Security
We implement industry-standard security measures including encryption in transit (TLS/SSL), encryption at rest, row-level security policies on all database tables, and regular security audits. Your data is stored on secure, SOC 2 compliant infrastructure.

We retain your account data for as long as your account is active. If you delete your account, we will delete your personal data within 30 days, except where retention is required by law.

9. Gator EMD Lender — Financial Data & Funding Privacy
Smart REAI offers an integrated EMD (Earnest Money Deposit) and Double Close funding feature ("Gator EMD Lender") in partnership with approved private lenders. When you submit a Gator EMD or Double Close funding request, you acknowledge:
- Data Shared with Lender: Your name, email, phone number, deal property address, purchase price, A-B contract, title company contact details, and risk confidence level are shared with the assigned lender (currently Justin Leaman) solely for the purpose of evaluating and funding your transaction.
- Contract Uploads: A-B Purchase Contracts you upload for funding requests are stored securely and accessible only to you, the platform founder (Sunny Days Finance LLC), and the assigned lender. These documents are never shared with any other third party.
- Fee Transparency: Gator EMD fees (50% of the EMD amount) and Double Close fees (1% of the purchase price) are disclosed upfront before submission. Fee splits between the acquisition agent and the founder are internal and do not affect the total fee you pay.
- Non-Refundable EMD: For Double Close transactions, the EMD is strictly non-refundable and applied to the purchase price at closing. This is disclosed at the time of request.
- Lender Response Data: Approval or rejection decisions, lender notes, and response timestamps are stored in your account and visible only to you and authorized platform administrators.
The Gator EMD Lender feature is not a bank, mortgage lender, or securities offering. It is a private transactional funding arrangement between consenting parties for the purpose of facilitating real estate wholesale and double close transactions.
10. Children's Privacy
Smart REAI is not intended for use by individuals under 18 years of age. We do not knowingly collect personal information from children.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by email or through the platform. Continued use of Smart REAI after changes constitutes acceptance of the updated policy.
